Maxmail strictly prohibits spamming activities of any kind. In accordance with our company policies and to protect the rights of others, Maxmail has a zero tolerance for affiliates and users who blatantly disregard our Anti-Spam Policy.
Definition of SPAMSpam is defined as including, but not limited to, the following:
- Electronic mail, phone, and fax messages address to a recipient with whom the sender does not have an existing business or personal relationship or is not sent at the request of, or with the express consent of, the recipient.
- Messages sent or posted to Usenet and message board that are misleading to potential referrals, misrepresenting your affiliation with a person or entity, unrelated to the topic of discussion, cross-posted to unrelated newsgroups, or posted in excessive volume.
- Solicitations posted in chat rooms or by use of instant messaging systems, PC to phone, voice-over-IP, or any similar communications.
- Electronic mail and fax messages sent that make use of or contain invalid or forged headers, invalid or non-existent domain names, or other means of deceptive addressing.
- Electronic mail messages that are relayed through any third party's mail servers without the permission of that third party, or any electronic mail message that hides or obscures, or attempts to hide or obscure, the source of an electronic mail message.
- The distribution of printed materials on private property or where otherwise prohibited.
Maxmail specifically does not authorize the use of its proprietary computers, servers, routers, and computer network (the "Maxmail Network") for spamming activities.
In no event shall any failure by Maxmail to enforce this policy constitute a waiver of Maxmail's rights.
For users:
Maxmail does not authorize the harvesting, collection, or distribution of affiliates' or referrers' names and e-mail addresses from the Maxmail Network for the purpose of sending unsolicited bulk e-mail. Such information can only be used for and is limited to business purposes in furtherance of the Maxmail Affiliate Program.
Should we determine that a spamming complaint is valid and you have intentionally violated this policy, Maxmail reserves the right to take all legal and technical steps to prevent you from entering, utilizing or remaining within the Maxmail and/or Genesis Web Strategies Network. Such action may include, without limitation, the use of filters or other network devices and the prosecution of offenders through criminal or civil proceedings.
Safe Email TipsDO NOT purchase any list from a vendor with offer that sounds too good to be true. For example: 30 millions e-mail addresses for $60. NEVER buy it! It is most likely a large list of unsolicited e-mail addresses.
DO NOT post your ad to newsgroups UNLESS that newsgroup specifically states in their agreement that advertisements are approved for the list. NEVER do it if you are uncertain.
DO NOT send any e-mail using a paragraph claiming that the law sanctions spam as long as there is a "remove from list" address in the spam message, or similar variations of this argument. For example: "Under Bill s.1618 Title III passed by the Congress, mail cannot be considered spam as long as we include a remove link for removal from this mailing list." NOTE: No bill or law gives you permission in any state or country to send unsolicited commercial e-mail.
These marketing methods are deemed spam and you will end up with severe penalties against you. Instead of making sales and getting new affiliates, you will offend people, lose your ISP, lose your reputation on-line, and lose your Maxmail account. Do not take the risk!
